Our PCSOS Research team respectfully submitted this resolution to our Board of County Commissioners (BOCC) today and requested them to put this on the agenda and vote to approve. Please contact our BOCC soon and request they approve this resolution. It is patterned after the one McIntosh County BOCC passed in July.

Resolution Wording

A Resolution Declaring a Moratorium on the Use of Payne County Maintained Roadways to Transport, Deliver Equipment, and Materials for the Construction of Utility-scale Wind Turbines, Utility-scale Solar Panels, and Associated Transmission Lines and Accompanying Equipment

Section 1: Findings and Purpose

The Board of County Commissioners finds that an immediate moratorium on the use of Payne County maintained roadways for the transport/delivery of equipment and materials for the construction of a utility scale wind or utility scale solar facility, utility scale Wind Turbines, and related infrastructure for any Wind Project, or for the construction of a solar panel facility of any type, or its infrastructure, including associated transmission lines in Payne County.

The moratorium will allow time to study and address the potential impacts such transporting of equipment and materials will have on Payne County maintained roadways and develop a road usage agreement with the wind or solar facility parent company or companies. This Resolution aligns with the statutory authority provided under OS Title 19.1.5 for counties.

Section 2: Moratorium Imposed

A moratorium is hereby imposed on the use of Payne County maintained roadways for the transport/delivery of equipment and material for the construction of a utility-scale wind or utility-scale solar facility within the legal boundaries of Payne County. This moratorium shall take effect immediately upon adoption and shall remain in effect for a period of 12 months, unless extended or repealed by the Payne County Board of Commissioners.

Section 3: Administration and Enforcement

Payne County will not allow transport/delivery of equipment and material to construct utility-scale wind or utility-scale solar facilities and associated facilities, including transmission lines during the period of the moratorium.

Section 4: Declaration of Study

It is hereby declared that a study on the impact of the transport/delivery of equipment and material for the construction of a utility-scale wind or utility-scale solar facility will have on Payne County maintained roadways, and the development of a road usage agreement shall be completed. This Resolution shall be in full force and effect from and after its passage and approval.

Therefore, be It Ordained by the Payne County Board of County Commissioners, Oklahoma, that it is hereby declared that the needed impact study be conducted on the utilization of Payne County maintained roadways and a road usage agreement be developed, and that this Resolution is and shall be in full force and effect from and after its passage and publication.
